Burbank Uninsured Motorist Case Settles for $100,000 After Arbitration Demand

Our client, a 75-year-old Burbank resident, was driving through the intersection of Burbank Boulevard and the southbound I-5 off-ramp when another driver came speeding off the freeway and ran a red light.

The other driver had been fleeing from CHP at speeds exceeding 100 mph. He slammed into the right rear of our client’s truck, causing it to spin out and become disabled in the roadway. The crash caused major damage to the vehicle and left our client with neck and shoulder injuries.

The at-fault driver fled the scene, was later arrested for felony hit and run and felony evading, and carried no insurance.

We pursued an uninsured motorist claim against State Farm, our client’s own insurance company. State Farm initially offered $66,904.34, then increased its offer to $70,000.

Although injections were recommended, our client chose to continue with conservative treatment. We believed the case was still worth more. We served a demand for arbitration and served formal discovery on State Farm.

The case ultimately resolved for $100,000, more than 49% above State Farm’s first offer.
